I am totally with you on this one.
I love Brian as a character. He is very balanced….half the time I want to slap him, the other half I find him an endearing chappie…..
He has cheated on his wife, been ruthless in business and , as we now discover flown a little close to the wind with his farm management practices.
His voice is,as you say unique…..just perfect.
I can’t see the way forward for Home Farm……

The partnership structure at Home Farm was never going to work given the personal dynamics of the individuals involved. Also the scriptwriters (or someone) have created an unholy mess.

    1. We were told ownership of the two cottages (Alice and Kate) had to revert to Home Farm in exchange for the single share each gets. Alice/Chris had used their cottage as security for the loan to buy the blacksmith business – luckily repaid before the cottage was handed back.

    2. We are now told that the land remains in Brian’s personal ownership and the partners are merely interested in the farming activities of the land.

    3. I am not very bright but I know a small cottage on farmland has a real and significant value – and Alice and Kate are presumably paying rent (well in Kate’s case the rent from her holiday lets) now go to Brian – because he owns the land and not into the farming partnership.

    4. I cannot believe the annual profits from the farming partnership (which appears to be meeting the “insured” costs of work at Low Mead) are likely to be adequate to equate to the rent Alice might be paying and to provide enough money to keep Adam and Debbie happy – as well as keeping Brian and Jenny in luxury.

    5. And just for a moment how is Jenny so stupid as not to have her name on the title deeds of Home Farm – my wife was put on our house title deeds when we remortgaged soon after we married (not worth an extra set of legal fees) – after 40 years Jenny has no rights?

    6. Frankly it looks to me like Brian can deny access to the farming partnership at any point given it is his land and he can employ a contractor to handle any crops.

It sounds like an economic, accounting and legal mess – it is a pity that proper independent advice was not sought by all participants before signing up. Ruth in particular has a problem. Assume Brian and Jenny die in an accident but for some reason we know Jenny dies first, so she does not inherit. There are two offspring of the marriage – Alice and Kate. They get 50% each of the land unless a will has been made. Has Ruth taken any steps to ensure that Ruari stands to benefit? I am not even sure Ruari’s birth certificate mentions Brian.

    Anyone know a good lawyer?
